&lt;p&gt;&lt;span&gt;Comment:&lt;br/&gt;&lt;/span&gt;&lt;span&gt;I am still not sure what my issue is exactly with this article but let me start by saying that I am biased. I am an entrepreneur, I run an online music licensing business and no we do not have to wait until 2050 to be successful.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;br/&gt;&lt;span&gt;What I like about the article is an American journalist mentioning European initiatives. Thanks, that&amp;#8217;s cool, almost unheard of and yes, Spotify and SoundCloud are both pioneers in the music space. Making mistakes is part of the deal but showing guts to do so and the flexibility to adapt is key. Respect.&lt;/span&gt;&lt;br/&gt;&lt;br/&gt;&lt;span&gt;What I don&amp;#8217;t like about the article is the focus. Looking at record labels or online distribution channels like YT, iTunes and Spotify is maybe sexy but by far not the area of the music industry generating money/profit. &lt;/span&gt;&lt;br/&gt;&lt;br/&gt;&lt;span&gt;And this is going on for over a decade now so this article is not helping investors attending the SF MusicTech Summit or entrepreneurs on a mission to generate money for nextgen DIY composers, bands and singer songwriters.&lt;/span&gt;&lt;br/&gt;&lt;br/&gt;&lt;span&gt;Can you make a healthy profit serving millions of consumers with a beautiful and sexy GUI on the front-end but licensing deals from the middle ages with labels, CBOs and publishers on the back-end? Nope, you can&amp;#8217;t.&lt;/span&gt;&lt;br/&gt;&lt;br/&gt;&lt;span&gt;So? The real music innovators (title of this article) are the ones who will concentrate on the dirty and by far not coolest job first: innovate the music licensing business. And I don&amp;#8217;t mean work out a clean, transparent, healthy licensing deal for the US only. Globally!&lt;/span&gt;&lt;br/&gt;&lt;br/&gt;&lt;span&gt;If you can change the value chain of music licensing and bypass the traditional players who cannot innovate, you will be rewarded by the ones who make our lives a better place: musicians. &lt;/span&gt;&lt;br/&gt;&lt;br/&gt;&lt;span&gt;Their trust in you will be the first step towards a successful and flexible music exploitation model. &lt;p&gt;We hired more talented people and shook off our magic &amp;#8220;we are still a startup&amp;#8221; blanket. Tribe of Noise is growing up and closing in on 20,000 Tribe members from 160+ countries: Our head of music is spoiling our customers with the best possible music, our community manager gives all her love to our creative crowd and in our kitchen more legal voodoo, technology wisdom and our &amp;#8220;power to the people&amp;#8221; message are melting into a powerful alloy. &lt;/p&gt;
&lt;p&gt;But still, call me impatient, we need to speed up and scale. My mission for 2013 and beyond is to scale Tribe of Noise to a business level where we can tell more and more talented and successful Tribe musicians to quit their daytime job and focus on their big passion: music.&lt;/p&gt;

&lt;p&gt;So our two magic words for 2013 will be &amp;#8220;&lt;strong&gt;scaling up&lt;/strong&gt;&amp;#8221;. I can&amp;#8217;t disclose the details but the future looks bright. In the meantime the stars seem to align even more in favor of DIY musicians and singer songwriters ready to take back control of their rights. &lt;/p&gt;
&lt;p&gt;Without boring you to death with legal mumbo jumbo here are a few developments you might want to pay attention to if you are in the music space:   &lt;/p&gt;
&lt;ul&gt;&lt;li&gt;From 2013, the U.S. Copyright Act permits composers and recording artists who signed away rights to their works on or after January 1, 1978, to recapture their rights.  &lt;/li&gt;
&lt;li&gt;The European Commission will introduce guidelines on collective management of copyright and demands more transparency and good governance from collecting societies. Another priority of the upcoming Directive is to stimulate multi-territorial music licensing. You will not see the full effect of this in 2013 but at least accountability will be on the agenda.&lt;/li&gt;
&lt;li&gt;More national initiatives empowering artists to renegotiate their contracts with music publishers, like the &amp;#8220;use it or lose it&amp;#8221; (non-usus) initiative in the Netherlands. &lt;/li&gt;
&lt;/ul&gt;&lt;p&gt;And on that bombshell and in the true spirit of the season, I wish you peace and joy… and some insane good music to listen to! Let’s make some Noise!&lt;/p&gt;

&lt;p&gt;So, what happened? We have signed a partnership with the world&amp;#8217;s leading in-store media solutions provider, &lt;a href="http://www.moodmedia.com" title="Mood Media website" target="_blank"&gt;Mood Media&lt;/a&gt;. If you&amp;#8217;ve never heard of them or don&amp;#8217;t fully understand why this is great news for independent artists let me explain and share my vision on how this will impact the music industry.&lt;/p&gt;

Music to them is one (and in my opinion the #1) medium to connect with millions of consumers daily in shops, supermarkets, hotels, etc. &lt;/p&gt;
&lt;p&gt;Does this mean every store, restaurant, supermarket, hotel will start calling our in-store music partners today to solely license Tribe of Noise music from now on? Can all the participating Tribe members submitting music to our all rights included in-store music catalog give up their daytime job next month? We&amp;#8217;re hopeful&amp;#8230; but not yet.&lt;/p&gt;
&lt;p&gt;Having said this, with any crisis, financial or otherwise, comes opportunity for creative expansion and alternatives. We&amp;#8217;re confident that we&amp;#8217;re a viable solution for both in-store media &lt;em&gt;and&lt;/em&gt; artists.     &lt;/p&gt;

&lt;p&gt;We spoke on a topic at the event that we&amp;#8217;re very familiar with - DIY.  Either people were feeling very generous or the panel went over well because we received quite a lot of positive feedback from attendees!  We&amp;#8217;ve been to enough events to know how rare it is for 6 panelists to find their groove which makes for a much more enlightening experience!  As such, we wanted to provide a few takeaways from our conversation.  An hour isn&amp;#8217;t a lot of time to dissect how to &amp;#8220;make it&amp;#8221; as an artist but we all collectively agreed on the following nuggets: &lt;/p&gt;

&lt;ul&gt;&lt;li&gt;Seems like a given, but DJs should produce their own work as to not get overlooked by booking.&lt;/li&gt;
&lt;li&gt;Doing it yourself means use all the tools you can get your hands on to engage with your fans, learn who they are, where they are and keep them close.&lt;/li&gt;
&lt;li&gt;The more rights you own the more flexible you are with closing deals with brands and media professionals in need for original music.&lt;/li&gt;
&lt;li&gt;Meet people, connect with people and do it often.  Don&amp;#8217;t be afraid to reach out and ask for help, you&amp;#8217;d be surprised at how many people are willing to help&amp;#8230;for free!&lt;/li&gt;
&lt;li&gt;Don&amp;#8217;t copy the success of someone else, be original and feel comfortable with the act/brand that you&amp;#8217;re developing.&lt;/li&gt;

&lt;p&gt;In one such case our artist, &lt;a href="http://pro.tribeofnoise.com/artists/show/20836" target="_blank"&gt;Suchitra Lata&lt;/a&gt; and her group &lt;a href="https://www.facebook.com/soularflareband" target="_blank"&gt;Soular Flare&lt;/a&gt;, decided to pen an ode, &amp;#8220;&lt;a href="http://soundcloud.com/soularflare/a-billion-hearts-soular-flare" target="_blank"&gt;A Billion Hearts&lt;/a&gt;,&amp;#8221; to their native India in hopes of inspiring the athletes who were participating on behalf of their home country.  We admit that we&amp;#8217;re biased, but biases aside it&amp;#8217;s an incredible song.  And we weren&amp;#8217;t the only ones who thought so!  After coming across their song on a blog post, an editor at CNN-IBN (CNN Indian Broadcast Network) did a feature on the group which you can see &lt;a href="http://www.youtube.com/watch?v=gPGuEHNlbGU" target="_blank"&gt;here&lt;/a&gt;.  Based on that feature, the group&amp;#8217;s local affiliate CNN-IBN, Bangalore invited the group back for a &lt;a href="http://www.youtube.com/watch?v=1mVFhgE9f74" target="_blank"&gt;live performance&lt;/a&gt; in their studios to kickoff the first day of the Olympics!  &lt;/p&gt;

Basically, it’s what Tribe of Noise aims to do but in event form. Given the mission of Encounters, we decided to send one of our Tribe artists, &lt;/span&gt;&lt;a href="http://www.tribeofnoise.com/saisse" target="_blank"&gt;André Saisse&lt;/a&gt;&lt;span&gt;, to the event to connect live with the likes of CD Baby, our partner Getty Images Music, Microsoft and Music Dealers.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;&lt;img src="http://media.tumblr.com/tumblr_m8cb2dtLfn1qzhd86.jpg"/&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;Our purpose in sending André was simple; he’s a great musician with a lot of talent and this was an opportunity for him in his own backyard, to connect with a diverse group of people he may otherwise not get the chance to meet. Initially André was only planning to go for one full day of the event but after meeting Melinda Lee from Getty Images Music (pictured here with André), she encouraged him to attend the 2nd day as well.  In doing so, he was able to connect with fellow musicians and friends he hadn’t seen in quite some time, as well as make new friends and meet influencers. &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;We love being able to bridge the offline and online experiences of Tribe of Noise such as with this event in Rio. Brazil has traditionally been a hotbed of great music and talented artists. With more and more eyes on Brazil, pending the next World Cup and the Summer Olympics 2016, we feel like showcasing these artists &lt;/span&gt;&lt;em&gt;now&lt;/em&gt;&lt;span&gt; who can influence campaigns featuring their home country, is essential.  Our platform is full of great Brazilian music which you can check out a sampling of &lt;/span&gt;&lt;a href="http://pro.tribeofnoise.com/search/filter?query=brazil" target="_blank"&gt;here&lt;/a&gt;&lt;span&gt;.  &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;So what’s the catch, what’s in it for us?  Really, there isn’t one.  The success of our artists is core to our lifecycle as a company and if we can help build on that success to garner even better music content, we will.  In this case, André is trying to get his music pushed out beyond the Brazilian market where he’s already had some nice exposure to date. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;It was the first time that the anxious musicians had seen their work come to life on the big screen. Unfortunately one group&amp;#8217;s video didn&amp;#8217;t make the cut but the other 7 videos debuted to a packed house. &lt;/p&gt;

&lt;p&gt;Earlier this week, DMX won a massive court battle against ASCAP and BMI signaling a significant turn for the music industry. In order to understand the impact of this court ruling let me first explain who DMX is.&lt;/p&gt;
&lt;p&gt;DMX began in 1971, as a music service to license and program original artist music. DMX’s primary focus was custom music programs for businesses. In the 80s, the company began providing services to international airlines, as well as residential and cable television systems.&lt;/p&gt;
&lt;p&gt;In 2012 Mood Media bought the company for $86.1 million. You should also know that Mood Media was bought the year before by Fluid Music based in Canada for $200 million (changing the name to Mood Media). The “new” Mood Media went on to round out their portfolio by acquiring Muzak for $345 million, positioning themselves as the largest in-store media specialist company in the world.  &lt;/p&gt;
&lt;p&gt;&lt;em&gt;So the largest in-store media company in the world wins two court cases against the two largest performing rights organizations in the world, ASCAP and BMI? Why is this massive? &lt;/em&gt;&lt;/p&gt;
&lt;p&gt;As stated in the &lt;a href="http://www.bloomberg.com/article/2012-06-18/aJ43dzcx781k.html" target="_blank"&gt;press release&lt;/a&gt; the ruling resets fee structures and limits market power long held by ASCAP and BMI. It set a precedent allowing performing artists and composers to negotiate and license their music directly with commercial music providers such as Mood Media and in our case, Tribe of Noise. &lt;/p&gt;
&lt;p&gt;One of the biggest hurdles facing the music industry is the segrated markets and the collective performing rights organizations (PRO’s) managing those regions.  Billions of dollars are collected by PRO’s like ASCAP, BMI, PRS, GEMA, SACEM and hundred of other smaller entities.  However it’s the management of this money that really stifles artists because their cut is generally not enough to sustain their work. &lt;/p&gt;
&lt;p&gt;In the Netherlands, where Tribe of Noise is based, our infrastructure is already set up so that we are executing “all rights included” music services together with (in-store) media companies as an alternative to performing rights organizations.  Essentially this ruling in DMX’s favor is a giant step forward in closing the gap between how licensing structures are regulated, aligning the U.S. and European regions more closely.  In other words, there are now more opportunities for artists to showcase their music globally with less interference from dubious middle men.&lt;/p&gt;
&lt;p&gt;If in-store media companies can pay-out the musicians directly without having to deal with performing rights organizations, the fees for the customers can come down (or more services could be offered for the same price) while the pay-out to the participating musicians will go up. Shorten the value chain, use technology for improved efficiency &amp;amp; transparancy and pay-for-play to the rightful owner(s) of the songs involved.&lt;/p&gt;
&lt;p&gt;While &lt;a href="http://digitalcowboys.com/2012/06/21/the-reality-of-the-new-music-business/" target="_blank"&gt;respected industry experts&lt;/a&gt; can&amp;#8217;t stop nagging these days about piracy and the lack of successful digital business models making up for the losses at major record labels, the music licensing business IS the #1 revenue generator in the industry.  In fact the fastest growing product that Mood Media offers is royalty free music.  It seems obvious to me that this is where the industry’s efforts should be focused instead of trying to reinvent the wheel.&lt;/p&gt;
&lt;p&gt;To give you an idea how big this industry is. In The Netherlands (Europe) the local BUMA/STEMRA and SENA together collect roughly $125 million a year for in-store media royalties. &lt;/p&gt;
&lt;p&gt;As with anything involving change, the implementation will likely be slow – there will undoubtedly be roadblocks along the way.  Many businesses in need for media don&amp;#8217;t know there is an alternative and last but not least: ASCAP and BMI are huge performing rights organizations but they are US based. Meaning, every single European country has its own ASCAP/BMI who will argue that the legislation doesn’t apply.  It will be interesting to see how this is challenged on a global scale and what countries may be next in line.   &lt;/p&gt;

A reality many SMEBBs (senior music executive baby boomers) still want us to ignore.&lt;/p&gt;
&lt;p&gt;Quote Emily: &amp;#8220;What I want is one massive Spotify-like catalog of music that will sync to my phone and various home entertainment devices&amp;#8230; hopefully with more money going back to the artist then the &lt;a href="http://www.hypebot.com/hypebot/2011/09/how-much-does-a-band-earn-from-each-music-platform-uniform-notion-shares-the-numbers.html" target="_blank"&gt;present model&lt;/a&gt;&amp;#8221;.&lt;/p&gt;
&lt;p&gt;Hm, would this be the answer? One massive Spotify-like catalog, aka UberTunes, the size of Facebook (~ 1 billion, 15% of the world&amp;#8217;s population) but with paying subscribers only. Of course prices of the monthly subscription fee should come down drastically to get enough people interested.&lt;/p&gt;
&lt;p&gt;Spotify&amp;#8217;s $10 per month is insane for many people on this planet. So UberTunes will charge $2 per month for an all-you-can-eat digital music service, giving you access to 20 million songs without geographical limitations. Half of them from major record companies, the other 10 million from emerging artists not known to any international audience yet.&lt;/p&gt;
&lt;p&gt;Let&amp;#8217;s do the math!&lt;/p&gt;

&lt;p&gt;This might not sound like the winning business model to you but:&lt;/p&gt;
&lt;ol&gt;&lt;li&gt;Artists signed to majors today end up with less than 20%&lt;/li&gt;
&lt;li&gt;Independents, 100% in control of their music, will get at least 40% and even more if they bypass some of the non creatives&lt;/li&gt;
&lt;/ol&gt;&lt;p&gt;So my message to Emily: Thank you for the inspiration!&lt;/p&gt;
&lt;p&gt;It will probably take many more years before a Facebook-sized company makes a move, the traditional music industry fully embraces the next generation customer and monthly all-you-can-eat subscription plans are priced below a &amp;#8220;tall&amp;#8217; coffee.&lt;/p&gt;
&lt;p&gt;But we should continue to question the traditional music industry models. Especially musicians should join the conversation, it&amp;#8217;s your life and creativity we are talking about! &lt;/p&gt;
